GENERAL TERMS AND CONDITIONS OF USE OF THE WEB STORE
GENERAL TERMS AND CONDITIONS OF USE OF THE WEB STORE byplank.com (hereinafter referred to as: General Terms) are drafted in accordance with the Consumer Protection Act, the Personal Data Protection Act, and the Electronic Commerce Act applicable in the Republic of Croatia.
PLEASE CAREFULLY READ THESE GENERAL TERMS AND CONDITIONS OF USE OF THE WEB STORE AS USERS.
- General Provisions
The owner of the web store byplank.com (hereinafter referred to as: web store BY PLANK) is BY PLANK d.o.o., for services, owned by Patricia Ćurković Rogić, Zagreb, Lovranska 10.
You accept these General Terms electronically when confirming an order in the web store. We also advise you to read the Privacy Policy (more), as well as the Cookie Policy (more), as these documents also relate to your use of the web store.
As a User, you agree to use the web store solely in accordance with applicable regulations for browsing published content, purchasing available products by submitting legally valid orders, and communicating with the seller.
The services provided to you through the web store do not include costs incurred by using computer equipment and other electronic devices (electronic devices) and services to access our web store. ByPlank is not responsible for phone charges, data traffic, or any other costs that may arise from ordering or browsing the content of the web store and using the services available on it.
All advertisements, photographs, and information about products subject to sale are the property of the Seller, who is solely responsible for the content of the advertisements, including the accuracy and truthfulness of the information and the obligations arising from the content of the advertisements.
The buyer can only be a legally capable adult natural person and legal entity. Contracts on behalf of minors and legally incapacitated persons can be concluded by their legal representatives or guardians.
- Changes to the General Terms
The version of the General Terms published on this page is always considered valid. In the event of disputes, the version valid at the time of purchase execution will be applied, with which you as a user have expressed your consent at the time of submitting the order.
The Seller reserves the right to amend or supplement the General Terms at any time without prior approval or special notice. Changes take effect on the day of publication on the website.
- Conclusion of a Sales Contract
The subject of the Contract is the purchase of the selected product through the web store BY PLANK with payment of the product price and delivery costs.
The Contract is concluded using means of distance communication (Remote Contract) via the Internet.
These General Terms, as well as individual sales conditions indicated with information about specific products, constitute an offer from the web store BY PLANK to conclude a Contract.
The User as the buyer, by registering, placing an order, or otherwise determined by these Terms, accepts them, thereby concluding a Contract between the user and the web store BY PLANK, according to the sales conditions specified in these Terms. These General Terms constitute an integral part of the contract with the user.
The contract does not come into effect based on the placed order and receipt of an automated message from the BY PLANK web store system confirming the order receipt, as the availability of the product may change at the time of the order placement.
The contract comes into effect and binds at the moment when the web store BY PLANK confirms the availability of the product and, depending on the payment method, sends an official binding offer for payment.
- Ordering
When browsing the content of the web store, you can freely select desired items and add them to the cart. This action is not in any way binding. After selecting the desired items and confirming your intention to purchase them, you proceed with the ordering process, during which you enter all the necessary data for order fulfillment, confirm your consent to the General Terms, and depending on the chosen payment method, make the payment.
Ordering goods is possible 24 hours a day, 7 days a week. Goods are ordered electronically.
After the order is completed and sent, the buyer will receive an automatically generated email message from the webshop BY PLANK system confirming that the order has been received.
If the Seller is unable to deliver all ordered products on time, they will inform the Buyer via email and inform them of other options. If the Buyer does not agree with the offered changes or delays, they can cancel the order in its entirety.
The Buyer can cancel the order until it is shipped, after which the Buyer is obligated to accept the shipment.
If the product is made to order by the Buyer, the Buyer is not entitled to cancel the order once the production of the product has started.
- Product Prices and Payment Methods
The prices of products are the same for all types of payments and are visible on the product page and in the cart when placing an order. The price of the product does not include delivery costs, which are calculated separately in the last step of the order after the user enters the desired delivery address. The Seller reserves the right to change the price without prior notice. In exceptional cases of administrative errors in displaying the price of products on the web store pages, we are not obliged to conclude a sales contract under unfavorable conditions. If such a case occurs, we will offer you to purchase the product at the correct price, without obligation to accept such an offer. In case of your non-acceptance of the offer, the amount paid will be refunded if the payment has been previously made by you. Transaction costs (bank fees) for refunding the payment will be borne entirely by BY PLANK.
Payment can be made by credit or debit card (Mastercard, Maestro, Visa, Visapay) at the time of order placement in the web store, by payment to our transaction account using internet banking, or by general payment slip.
The online store BY PLANK offers various payment methods:
- cash on delivery via the GLS delivery service,
- by offer (via order) to the company’s account,
- card payment
In Zagreb (Lovranska 10), cash payment is possible. In that case, feel free to place an order and select the “personal pickup at the company’s address” option.
The Buyer agrees to the general terms that apply at the time of purchase (order submission on the online website www.byplank.com).
BY PLANK d.o.o. for services undertakes to provide the Buyer with the following information:
a) company identity (name and registered office of the company, company registration and PIN),
- b) contact details enabling quick and efficient communication (email, telephone),
- c) essential features of the products or services (including sales services and warranties),
- d) product availability (every product offered on the website is available within a reasonable time),
- e) terms of product delivery (method, place, and deadline for delivery),
- f) all prices must be clearly defined and must be clearly displayed whether they include tax and transportation costs,
- g) payment method and delivery,
- h) validity period of the offer,
- i) deadline for canceling the contract and conditions for termination; also, whether and how much it costs the buyer to return the product,
- j) explanation of the complaint procedure, including all contact information or customer service contact details.
The Sales Contract between BY PLANK d.o.o. for services and the buyer in the online store is valid at the moment BY PLANK d.o.o. for services sends the first email confirmation of the order status. From that moment, all prices and other conditions are fixed and valid for BY PLANK d.o.o. for services and for the buyer.
The Sales Contract (i.e., the first email about the order status) is stored in electronic form on the server www.byplank.com and is available to consumers upon their written request.
Statement on Online Payment Security
When making purchases on our web store, please use CorvusPay – an advanced system for secure acceptance of credit card payments over the internet.
The CorvusPay system ensures complete confidentiality of your credit card and personal data from the moment you enter them into the CorvusPay payment form. Payment data is encrypted from your web browser to the bank that issued your card. Our store never comes into contact with the complete data of your payment card. Additionally, the data is inaccessible even to CorvusPay system employees. An isolated core independently transfers and manages sensitive data, keeping it completely secure.
The payment data entry form is secured with SSL transport encryption of the highest reliability. All stored data is further protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. CorvusPay meets all security requirements for online payments set by leading card brands and operates in accordance with the PCI DSS Level 1 standard – the highest security standard in the payment card industry. When paying with cards included in the 3-D Secure program, your bank, in addition to validating the card itself, further confirms your identity using tokens or passwords.
Corvus Pay considers all collected information confidential and treats it accordingly. The information is used solely for the purposes for which it is intended. Your sensitive data is completely secure, and their privacy is guaranteed by state-of-the-art protective mechanisms. Only data necessary for conducting business in accordance with prescribed stringent procedures for online payment is collected.
Security controls and operational procedures applied to our infrastructure ensure the immediate reliability of the CorvusPay system. Additionally, strict access control, regular security monitoring, and in-depth network vulnerability checks, as well as the planned implementation of information security provisions, continuously maintain and improve the security level of the system by protecting your card data.

You will receive an invoice with your package or as a separate shipment, depending on the shipping location. If you require an R1 invoice, please add a note during the ordering process and enter all necessary information. The issuance of R1 invoices is currently available as an option only to legal entities registered in the Republic of Croatia.
- Delivery and Payment Methods
Payment Methods
The BY PLANK online store offers the following payment methods:
Cash or card upon delivery via GLS or payment via bank transfer to the company’s account. Products can be picked up in cash at the company’s address (Lovranska 10, 10000 Zagreb).
Packaging and delivery costs are free for purchases over €150. Shipping costs depend on the product and are €5.65 for purchases below €150, with additional charges for island delivery.
For international orders, the delivery price depends on the zone in which the country for parcel delivery is located, and you can check the price for a specific zone when making a purchase in the shopping cart. Shipping is free for purchases of €220 or more.
Personal pickup in Zagreb is also possible. In this case, there are no delivery costs.
Warning: These delivery terms and costs apply only within the Republic of Croatia.
As part of our promotional offers, the seller may offer free delivery for orders during the promotion period or promotional sales of certain products.
Ordered products will be delivered by:

Delivery to islands is scheduled according to the predetermined schedule of the island delivery service.
The delivery service publishes the island delivery schedule on its website.
After your order has been shipped, you will receive an email with the shipment number and tracking instructions.
Delivery does not take place on Saturdays and Sundays.
The recipient is obliged to provide an accurate mobile phone number for timely delivery information. If you have received a notification from the delivery service about the arrival of the shipment, you can contact them to arrange subsequent delivery or delivery to a different address.
Products will be packaged to prevent damage through normal handling during transport. The buyer is obligated to check for any damages upon product receipt and immediately report them to the courier or refuse to accept the shipment if there are visible external damages. The goods are insured against loss during delivery.
The buyer is obliged to sign the delivery note upon receiving the goods, and the GLS delivery service considers it as confirmation of receipt. By signing the confirmation of receipt, it is considered that the product has been received without any visible external damages.
If the buyer orders goods and refuses to accept them, the seller has the right to request reimbursement of delivery and its own handling costs from the buyer.
Invoice Issuance
BY PLANK d.o.o. for services will send the invoice to the buyer via email upon delivery and payment of the ordered items. The invoice includes item prices and all purchase-related costs. The buyer is obliged to check the accuracy of the data before submitting the order.
Discount Code
The discount code or promotional code provides various benefits when purchasing through the online store www.byplank.com. The active code can be found on the homepage in the BY PLANK d.o.o. for services’ email or other media. The code offers various benefits, from different gifts to discounts. Each code is time-limited and must be used within a specified period, and it expires after that period.
Using the discount code:
- Select the products you want to purchase and add them to the shopping cart.
- At the checkout, enter the discount code in the “promotional code” window and click the “confirm” button.
- Only one discount code can be used per purchase.
- When you enter the discount code, its value will be automatically deducted from the price of your order.
- The remaining amount to be paid will be displayed.
Purchase Process
I. Product Selection
On the online website www.byplank.com, select the product and click on the “Add to Cart” link. The system will notify you that the product has been successfully added to the cart. You can continue shopping or select “View Cart” or “Checkout.”
II. Removing Products from the Cart
On the online website www.byplank.com, in the top right corner, there is a shopping cart icon that, when clicked, displays the products added to the cart. If the user wants to remove a specific product from the cart, they must click on the cart icon and then click on the “x” to remove it.
III. Shopping Cart
To complete the order, you must fill in the required fields.
Delivery Address: You must enter the required contact information marked with an asterisk (name, surname, email, address, city, postal code, and phone number) needed for order confirmation, order completion, and product delivery.
The form allows you to create a user account, and the user’s data will be saved for the next order.
Delivery Cost: The user can choose between GLS delivery service or personal pickup of the package in Zagreb.
Payment Method: You can choose between three payment methods: Cash on delivery, direct bank transfer, or credit card payment.
Coupons and Gift Cards: If the user has a discount coupon or gift card, they must enter it in the appropriate field and click the confirm button.
Order Review: The products added to the cart in the online store are displayed. The product price, shipping cost, and total cost are visible in the shopping cart before the order is completed.
Order Conclusion: The user can review the delivery details, chosen payment method, and cart contents. The user confirms the order by clicking the “Order” button. If the order was successfully completed, the page will display the text “Thank you. Your order has been received. Your order number is: xxxx.”
Purchase Notification Process
After submitting the order, the buyer receives a notification via email that the order has been received.
BY PLANK d.o.o. for services may call the buyer on their phone number to verify the data.
The purchase process for legal entities is entirely the same as for natural persons, except that at the end of the order, the legal entity must provide the company name and PIN. Payment options are entirely the same.
- Returns and complaints, objections
Unilateral Termination of Contract, Return, Exchange of Items, and Refund
Under Article 72 of the Consumer Protection Act, the consumer has the right, without stating a reason, to unilaterally terminate the contract within 14 days from the date of taking possession of the item.
In accordance with Article 79 of the Consumer Protection Act, the consumer does not have the right to unilaterally terminate the contract if the subject of the contract is a product made according to the consumer’s specifications or clearly tailored to the consumer.
In the form of an Information Form (link: Information Form on the Right to Unilaterally Terminate the Sales Contract – Consumer Protection Act), the rights and obligations of the Buyer, as well as the rights and obligations of the Seller in case the user’s rights to unilaterally terminate the sales contract are realized, are specified.

The buyer bears the direct costs of returning the goods (delivery costs).
The products returned by the buyer must be undamaged, unworn, unwashed, and with original tags.
The user/buyer is responsible for any decrease in the value of the goods resulting from handling the goods.
In the case of unilateral termination of the contract, the buyer may choose:
- to receive a refund of the paid funds, in which case the buyer must return the goods to the seller’s address at their own expense, and the seller, after receiving and verifying the goods, transfers the funds to the buyer’s account minus the delivery costs, or
- to exchange the item for another item or exchange the same item for a different color. In this case, the buyer must return the goods to the seller’s address at their own expense, and after receiving the goods, the seller sends the exchanged item or the same item in a different size to the buyer and charges the return delivery costs and any price difference. Transaction costs (bank fees, etc.) are borne by BY PLANK.
In the event that the Buyer decides to return the money, we will transfer the amount equal to the selling price of the returned products to your current account (without delivery costs). The buyer should state the IBAN number and the bank with which the current account is opened and the telephone number on the Form for unilateral termination of the sales contract.
- Complaints
The seller is responsible for material defects if the product had a defect at the time of the risk transfer to the buyer, regardless of whether the seller was aware of it. The seller is also responsible for material defects that occur after the risk transfer to the buyer if they result from causes that existed before that. The seller is not responsible for minor material defects.
When complaining about a material defect in the product, the buyer must fill out a written consumer complaint and send it to the seller within the legal deadline.
The complaint will be considered valid if an inspection of the product determines that it meets the conditions for a complaint according to the Obligations Act and the Consumer Protection Act.
Complaints can be submitted through a written consumer complaint (the consumer complaint form is available below).

- Settlement of Consumer Disputes
We will attempt to resolve any disputes amicably – by mutual agreement. You can also use mechanisms for out-of-court settlement of consumer disputes by initiating out-of-court dispute resolution proceedings by submitting an application to the Court of Honor of the Croatian Chamber of Commerce, and/or by submitting a proposal for mediation to the Mediation Center of the Croatian Chamber of Commerce.
